These Terms & Conditions govern access to modernwellnesssolutionsga.com, account use, catalog access, and orders submitted to Modern Wellness Solutions LLC (“Modern Wellness Solutions,” “we,” “us,” or “our”). By using the site, creating an account, or submitting an order, you agree to these Terms, our Privacy Policy, Research Use Policy, FDA & Research-Use Disclaimer, Shipping & Returns Policy, and applicable product or lot documentation.
1. Eligibility and accurate information
You must be at least 21 years old, legally able to enter an agreement, and authorized to act for any organization you identify. You must provide accurate, current identity, contact, billing, shipping, and affiliation information and keep account credentials secure.
2. Laboratory research use only
All materials and information are offered solely for lawful laboratory research. Products are not for human or animal consumption and are not for clinical, diagnostic, therapeutic, dietary, cosmetic, household, or veterinary use. Requests for dosage, reconstitution, administration, personal use, or another prohibited purpose are not permitted.
3. Customer representations
- You are at least 21 years old.
- Your purchase is solely for lawful laboratory research.
- You have appropriate training, facilities, equipment, access controls, and safety procedures.
- You will comply with applicable laws, institutional requirements, labels, and lot documentation.
- You will not relabel, resell, market, or use materials for a prohibited purpose.
- Your account, payment, and shipping information is accurate.
4. Orders, review, and acceptance
An order submission is an offer to purchase, not our acceptance. We may verify, hold, decline, limit, or cancel an order because of payment status, inventory, destination, suspected prohibited use, fraud screening, documentation needs, pricing or catalog errors, or legal and compliance review. An order is not treated as paid until payment is confirmed through the enabled payment provider. If we cancel a confirmed paid order before fulfillment, the available refund or reversal process will be explained to the customer.
5. Pricing, payment, and taxes
Prices are stated in U.S. dollars. Applicable shipping and taxes are displayed before final submission. We may correct obvious pricing, description, image, availability, or catalog errors and may cancel an affected order. Payment services are provided by independent processors under their own terms.
6. Shipping and delivery
We currently ship only to eligible addresses in the contiguous 48 United States. The standard shipping charge is $13 per order; no free-shipping threshold is offered. We do not ship to P.O. boxes. Adult signature or age verification may be required. Customers are responsible for providing a complete deliverable address and promptly reviewing tracking. Processing estimates are not guaranteed delivery dates, and carrier or weather delays may occur. Additional claim and return procedures are stated in our Shipping & Returns Policy.
7. Inspection, claims, and returns
Inspect deliveries promptly. Report damaged, incorrect, missing, compromised, or undeliverable shipments using the time, photographs, packaging, label, lot, and tracking information requested in the Shipping & Returns Policy. Because material integrity cannot be verified after delivery, returns may require advance authorization and may be unavailable for opened, mishandled, or improperly stored materials. Nothing in this section limits rights that cannot lawfully be limited.
8. Certificates, images, and product information
A certificate of analysis applies only to the identified submitted sample and lot. It is not a warranty of suitability for a prohibited purpose. Product images, colors, labels, and packaging may vary without changing the identified compound, strength, or applicable lot documentation. Do not infer purity, sterility, stability, storage, or other characteristics that are not expressly stated in the applicable documentation.
9. Storage, handling, and customer responsibility
Customers are responsible for reviewing labels and lot documentation, using appropriate personal protective equipment, preventing contamination and unauthorized access, maintaining suitable laboratory controls, and complying with applicable laws and institutional requirements.
10. Site use and intellectual property
The Modern Wellness Solutions name, logo, artwork, product photography, vial characters, written content, and site design are protected to the extent allowed by law. You may not impersonate another person, submit fraudulent information, abuse credentials, introduce malware, interfere with the site, bypass age or catalog controls, or scrape the service in a way that disrupts operations or violates applicable law.
11. Third-party services
Domain registration, DNS, EasyWP hosting, security, analytics when enabled, email delivery, payment processing, address validation, and shipping may be provided by independent third parties, including Namecheap services and the payment provider offered at checkout. Those providers operate under their own terms and privacy notices. We are not responsible for third-party services outside our control, but we select and use them to support site and order operations.
12. Communications and privacy
Our Privacy Policy describes how information is handled. Essential account, security, order, support, shipping, and policy communications are part of operating the service. Optional marketing, if offered, will use separate consent and an available opt-out method.
13. Disclaimers
Products and site information are not medical advice, healthcare, diagnosis, treatment, veterinary advice, or evidence of FDA approval. To the extent permitted by law, the site, content, and materials are provided without implied warranties of merchantability, fitness for a prohibited purpose, or non-infringement. Nothing excludes warranties or obligations that cannot lawfully be excluded.
14. Limitation of liability and indemnification
To the extent permitted by law, Modern Wellness Solutions is not liable for indirect, incidental, special, consequential, or punitive losses arising from prohibited use, misuse, improper handling, unlawful resale, false information, or breach of these Terms. You agree, to the extent permitted by law, to defend and indemnify Modern Wellness Solutions against third-party claims caused by your prohibited use, unlawful conduct, misrepresentation, or breach. Nothing limits liability that cannot lawfully be limited.
15. Account restriction and termination
We may restrict or close an account, cancel access, or decline an order for suspected prohibited use, fraud, security abuse, inaccurate information, legal risk, or policy breach. Any paid-order adjustment will be handled under the payment and order provisions above.
16. Governing law, changes, and severability
These Terms are governed by applicable United States law and the laws of the State of Georgia, without overriding rights that apply under another jurisdiction’s mandatory law. We may update these Terms by posting a revised date; subsequent use and orders are governed by the current version. If a provision is unenforceable, the remaining provisions remain effective to the extent permitted by law.
